Terms and Conditions

These Terms and Conditions apply to all services provided by Konanggo Aboriginal Cultural Heritage Services (KACHS) and to use of this website, unless otherwise agreed in writing.

By engaging KACHS services or accessing this website, you agree to these Terms and Conditions.

Services

KACHS provides Aboriginal and Torres Strait Islander cultural services including cultural education, truth telling sessions, workshops, tours, consultancy, and related programs. All services are delivered in accordance with cultural protocols and are informed by lived experience and cultural knowledge.

Bookings and payment

Bookings are confirmed once written confirmation is received and any required deposit has been paid. Payment terms, including deposits and final payments, are outlined on invoices and must be met within the specified timeframes.

Failure to make payment may result in cancellation, rescheduling, or suspension of services.

Cancellations and changes

Cancellations, rescheduling, and changes to services are subject to the Booking and Cancellation Policy available on this website.

Aboriginal and Torres Strait Islander cultural and intellectual property

All Aboriginal and Torres Strait Islander cultural knowledge, stories, practices, materials, images, designs, symbols, language, and information shared or provided by KACHS are protected cultural and intellectual property.

This includes, but is not limited to, spoken teachings, storytelling, artwork, designs, workshop content, training materials, recordings, photographs, video, and any other cultural expressions shared during KACHS services.

This cultural and intellectual property remains the ownership of the relevant Aboriginal and Torres Strait Islander knowledge holders and or KACHS. Participation in KACHS services does not grant permission to record, copy, reproduce, adapt, publish, distribute, or use any cultural knowledge for any purpose without prior written consent.

Unauthorised recording, use, or reproduction of Aboriginal and Torres Strait Islander cultural knowledge may cause cultural harm and is strictly prohibited. KACHS reserves the right to take appropriate action where cultural and intellectual property is misused or cultural protocols are not respected.

Cultural protocols and conduct

Participants are expected to engage respectfully and follow cultural guidance provided during services. Where cultural protocols are outlined, they must be respected at all times.

KACHS reserves the right to modify, pause, or cease services if cultural safety is compromised or participant behaviour is inappropriate.

Photography and media

Photography and video recording during services may only occur with consent. Use of images and recordings is governed by the Image Consent and Media Policy available on this website.

Limitation of liability

KACHS takes reasonable care in delivering services. To the extent permitted by law, KACHS is not liable for loss, damage, injury, or expense arising from participation in services, except where required by law.

Website use

Information on this website is provided for general information purposes only. While reasonable efforts are made to keep content accurate and current, KACHS does not guarantee completeness or accuracy.

Changes to these terms

KACHS may update these Terms and Conditions from time to time. Any updates will be published on this website.

Governing law

These Terms and Conditions are governed by the laws of New South Wales, Australia.
